When the railways were constructed, they were required to fence their land ‘in perpetuity’. However, they were empowered to pay compensation to adjacent landowners in return for a release from any obligation to fence. The responsibility for maintaining fences bordering railway land may be given in the deeds of the adjacent property, or if not, should be checked with the railway authority.
