The Town and Country Planning General Development Order 1977 gives general permission for erection of gates, fences, walls and other means of enclosure that do not exceed one metre in height, when abutting upon a road used by vehicles, or two metres elsewhere.

The formation or laying out of means of access to highways requires planning permission. This applies to access, whether private or public, for vehicles or pedestrians. The General Development Order gives an automatic consent for access onto unclassified roads where:

  • The work is required in connection with development for which permission has been given, or
  • access is required, but not in connection with any development.

Check with the District Council if there is any doubt over the status of the road in question, or whether any intended work will constitute development.

No gate may open out onto a street, except in the case of a public building and with the consent of the Highway Authority.
